Commission for Maddie Ellis: Painting Balance

PROJECT SCOPE

8” x 16” oil on stretched canvas tree painting, based on client photos/video from Childhood home.

TIMING

Upon approval of the contract and deposit of 50% of the commission, Bri Custer will outline a commission calendar including a zoom meeting to discuss the sketches and trajectory of the final piece. Work on the painting will commence as soon as the client and artist have agreed on a sketch to work from. Work on the painting will take up to a month. The painting will be shipped after adequate dry time which will take as little as four weeks and as long as eight depending on humidity levels. Bri Custer retains the right to allow for an appropriate amount of drying time before shipping the painting to ensure safe transport of the work.

COMPENSATION

The client shall pay the artist a total fee of $830 USD as total compensation for the project detailed above, not including shipping or framing costs. 50% is due at the entrance of the contract, 50% due upon completion and before shipping. Pickup in Concord, NH is available at no cost to the client.

TERMINATION

Client may terminate this agreement at any time by sending a written notice to the artist at bri@bricuster.com. Upon such termination, the client forfeits the right to any completed work and the 50% non-refundable deposit. The client is released from the remaining balance. Shipping and framing costs are not refundable.

RIGHTS

Bri Custer retains all rights to the artwork provided to the client prior to and following completion of the sale. Reproduction of the artwork without the written consent of the artist shall be prohibited.

Bri Custer may use work in portfolio (including, but not limited to, any website that displays artist's works and social media platforms). When asked, the client must properly identify the artist as the creator of the work. Client does not have a proactive duty to display artist's name together with the work, but client may not seek to mislead others that work was created by anyone other than Bri Custer.
